There are inherent and other risks including injury and death involved in the sports of snow skiing, snowboarding, and skiboarding for which the equipment purchased is to be used.
The binding system sold with each ski is designed to release the ski boots from the ski to minimize such injuries; however, there is no guarantee of the users safety nor can it be reasonably predicted that the binding system will release at all times and under all circumstances where the release may prevent injury or death.
Snowboard and skiboard bindings are not designed to release.
Bindings are not shipped installed on the equipment. It is the purchasers responsibility to have the bindings installed by authorized dealers to install the bindings for the particular make and model purchased. You may incur an additional charge for binding installation - most ski and snowboard shops, ski resorts and snowboard parks perform this service.
By having the bindings installed, the purchaser (and to whomever the purchaser assigns, gifts, or sells this equipment to) accepts full responsibility and liability of any such claims, damage, events, injuries, and deaths related to the use of such equipment and hereby holds harmless, indemnify and release from any legal liability Alpine Ski Center, its owners, agents, and employees, as well as the manufacturers and distributors of this equipment for any loss or damage including any that results from claims for personal injury or death to the purchaser or to any person or property damage resulting from the selection, installation, maintenance, adjustment or use of this equipment and for any claim based upon negligence, breach of warranty, contract or other legal theory, accepting the purchaser the full responsibility for any and all such damage, injury, or death which may result.
IF, the purchaser does not accept these terms then the equipment (with bindings not installed) is to be returned immediately to Alpine Ski Center and the purchaser will receive a full refund of the price paid for the equipment.
Alpine Ski Center will not accept equipment where the bindings have been installed. Shipping cost to and from the purchaser is not refundable.
These terms will be governed by the applicable law of the state of North Carolina, and if any part of this agreement is determined to be unenforceable, all other parts shall be given full force and effect.
